How does the HITECH apply to me, the broker?
Agents, brokers, third party administrators and company representatives are included under the regulations and referred to as Business Associates.
You are considered a Business Associate if you receive, transmit, create or maintain protected health information (PHI) or if you have received a Business Associate Agreement.
You are required to implement certain privacy as well as physical technical and administrative safeguards, as required by HIPAAA privacy and security regulations. The effective date for compliance: February 17, 2010.
Penalty for non compliance:
The penalties can range from $100 per violation to $50,000 per violation with a maximum fine of $1.5 million dollars!
